1. AGREEMENT TO TERMS

By accessing Thandi.ai, you agree to these Terms of Service. If you disagree, do not use our service.

Beta Status: You acknowledge this is a beta version with potential errors, bugs, and incomplete features.

2. ELIGIBILITY

Students:

  • 13+ years old (with parental consent if under 18)

  • Currently enrolled in South African educational institution

  • Provide accurate academic information

    • Schools:

  • Registered South African school

  • Provide authorized representative contact

  • Ensure student consent compliance

    • 3. SERVICES DESCRIPTION

    Thandi.ai provides AI-powered:

  • Career guidance recommendations

  • University program matching

  • Bursary opportunity identification

  • Academic pathway planning

    • BETA SCOPE: Features may change; service availability not guaranteed; results may contain inaccuracies.

    4. USER OBLIGATIONS

    You agree to:

  • Provide accurate, current information

  • Maintain confidentiality of login credentials

  • Not share other users' information

  • Use service for intended educational purposes only

  • Not attempt to reverse-engineer our AI models

  • Report bugs and inaccuracies

    • 5. INTELLECTUAL PROPERTY

  • All AI models, algorithms, and software owned by Thandi AI (PTY) LTD

  • You retain ownership of your personal information

  • We grant limited license to use the service

  • Generated reports are for personal/educational use only

    • 6. DISCLAIMERS

    NO GUARANTEE OF ACCURACY:

  • Career/uni recommendations are probabilistic, not deterministic

  • Admission requirements change; always verify independently

  • Bursary information may be outdated

  • Not a substitute for professional career counseling

    • NO GUARANTEE OF OUTCOMES:

  • We do not guarantee university admission

  • We do not guarantee bursary awards

  • We do not guarantee employment outcomes

    • BETA QUALITY:

  • Service may be unavailable without notice

  • Data loss may occur (use at your own risk)

  • Features may be removed or changed

  • No SLA or uptime guarantees

    • 7. LIMITATIONS OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Thandi AI (PTY) LTD is not liable for any direct, indirect, incidental, special, consequential, or punitive damages

  • Total liability capped at ZAR 0 during beta phase (free service)

  • We are not liable for decisions made based on our recommendations

  • We are not liable for third-party bursary/university website errors

    • FORCE MAJEURE: Not liable for failures due to circumstances beyond our control.

    8. INDEMNIFICATION

    You agree to indemnify and hold harmless Thandi AI (PTY) LTD from any claims arising from:

  • Your breach of these Terms

  • Your violation of any law

  • Misrepresentation of academic data

  • Sharing of credentials

    • 9. TERMINATION

    By You: Stop using the service anytime; request data deletion.

    By Us: We may terminate or suspend access immediately, without notice, for:

  • Terms violation

  • Suspected fraud

  • Security concerns

  • Technical necessity (beta phase)

    • Effect of Termination: Upon termination, your right to use ceases immediately; we may delete your data.

    10. DISPUTE RESOLUTION

    GOVERNING LAW: South African law, specifically the Electronic Communications and Transactions Act 25 of 2002.

    JURISDICTION: KwaZulu-Natal High Court (Durban) has exclusive jurisdiction.

    MEDIATION: Before litigation, parties must attempt mediation (South African Institute of Mediators).

    11. MODIFICATIONS TO TERMS

    We may modify Terms at any time. Continued use after notification constitutes acceptance.

    Beta users will receive 14-day notice of material changes.

    12. BETA-SPECIFIC TERMS

  • No fees during beta; pricing subject to change

  • Data may be used for research (anonymized)

  • Feedback provided becomes our property

  • No guarantee of continued free access after beta

  • We may discontinue beta without notice

    • 13. SEVERABILITY

    If any provision is invalid, remaining provisions remain enforceable.

    14. ENTIRE AGREEMENT

    These Terms constitute the entire agreement between you and Thandi AI (PTY) LTD.
